Agency Terms of Business
My Travel Guys – Agency Terms of Business
These are the terms on which My Travel Guys acts as an agent when arranging travel services for you. Please read them carefully before making a booking.
1. Our role as an agent
Except where otherwise stated, My Travel Guys acts only as an agent (or sub-agent) in respect of all bookings we take and/or make on your behalf.
When making a booking, we will arrange for you to enter into a contract with the relevant travel supplier(s) (such as a tour operator, airline, cruise line, hotel or accommodation provider). Your contract will be directly with the supplier(s) named on your booking confirmation or invoice, and their terms and conditions will apply to your booking.
As an agent, we are not responsible for the acts or omissions of the supplier(s), or for the services provided by them. We strongly advise that you read the supplier’s booking conditions carefully, as they contain important information about your travel arrangements.
These Agency Terms of Business are governed by English law and the jurisdiction of the courts of England and Wales (unless you live in Scotland or Northern Ireland, where you may choose local jurisdiction).
⸻
2. Making a booking and payment
When you make a booking, you confirm that:
• you are at least 18 years of age;
• you have the authority to accept these terms on behalf of all members of your party; and
• all information you provide is accurate and complete.
To confirm your booking, you must pay the required deposit (or full balance if requested) as set by the supplier. Your booking is confirmed once we issue written confirmation on the supplier’s behalf.
Please check all booking details carefully on receipt and notify us immediately of any errors. Names must match passports exactly. Any changes may incur charges imposed by the supplier and/or an administration fee.
All monies you pay to us are held on behalf of the relevant supplier(s) unless otherwise stated.
⸻
3. Prices and availability
Prices shown are subject to availability and may change at any time. Errors and changes can occur. The final price of your booking will be confirmed at the time of booking.
⸻
4. Travel insurance
We strongly recommend that all customers take out comprehensive travel insurance to cover cancellation, medical expenses, repatriation, baggage loss and other risks. Some suppliers require insurance as a condition of booking.
⸻
5. Changes and cancellations
Any request to amend or cancel a booking must be made by the lead passenger in writing. All amendments and cancellations are subject to the supplier’s booking conditions and charges, which may be up to 100% of the booking cost.
In addition, My Travel Guys may charge an administration fee of £25 per person for changes or cancellations.
⸻
6. Our responsibility
Your contract for travel arrangements is with the supplier(s). Our responsibility is limited to making the booking in accordance with your instructions. If we are found liable to you on any basis whatsoever, our maximum liability will be limited to twice the cost of your booking (or the appropriate proportion of this if not all party members are affected). Nothing in these terms limits liability for death or personal injury caused by our negligence.
⸻
7. Financial protection (IMPORTANT)
All package holidays we sell come with financial protection. If you buy a single travel service, this protection may not apply.
When you buy an ATOL-protected flight or flight-inclusive holiday, you will receive an ATOL Certificate. This confirms what is financially protected and who to contact if things go wrong.
Linked Travel Arrangements
If you book additional travel services after booking your first service, you may not benefit from package travel protections unless the booking meets the criteria of a Linked Travel Arrangement under the Package Travel and Linked Travel Arrangements Regulations 2018.
We have taken out insolvency protection with ABTA – The Travel Association. If services are denied because of our insolvency, you may contact ABTA at:
30 Park Street, London SE1 9EQ
claims@abta.co.uk | 0203 758 8779
This protection does not cover contracts with parties other than with us.
⸻
8. Passports, visas and health requirements
You are responsible for ensuring you meet all passport, visa and health requirements for your travel. Requirements can change, and neither we nor the supplier(s) accept responsibility if you are unable to travel due to non-compliance.
⸻
9. Complaints
As your contract is with the supplier, any issues during travel should be reported immediately to the supplier or their representative. If you wish to raise a complaint after return, please contact us in writing.
If the issue cannot be resolved and involves an ABTA member, you may use ABTA’s Alternative Dispute Resolution scheme. Further details are available at www.abta.com.
